999 / 911 Emergency Safety Feature
CRITICAL NOTICE - READ BEFORE USING THE EMERGENCY FEATURE
GODSOWNAPP\'S EMERGENCY FEATURE IS A SUPPLEMENTARY TECHNOLOGY TOOL ONLY. IT IS NOT A SUBSTITUTE FOR CALLING 999 (UK) OR 911 (USA) DIRECTLY. IN ANY GENUINE EMERGENCY, ALWAYS CALL 999 OR 911 FIRST. GODSOWNAPP LIMITED ACCEPTS NO LIABILITY WHATSOEVER FOR ANY FAILURE OF THIS FEATURE TO FUNCTION, CONNECT, ALERT, OR DELIVER ASSISTANCE --- INCLUDING WHERE SUCH FAILURE RESULTS IN INJURY OR DEATH. USE OF THIS FEATURE IS ENTIRELY AT THE USER\'S OWN RISK.
1. Scope and Application
1.1 These Emergency Services Terms govern use of GodsOwnApp\'s emergency alert and safety feature (\"Emergency Feature\") by all user types.
1.2 These terms supplement and must be read alongside the General Terms (01-General-Terms.md), which apply in full --- including the £1/\\1 maximum liability cap and the exclusion of personal liability for all GodsOwnApp Limited directors and employees.
1.3 The Emergency Feature is the only active GodsOwnApp service until mid-March 2027.
2. Nature and Limitations of the Emergency Feature
2.1 The Emergency Feature is a technology-assisted alert system designed to:
- Enable users to raise a personal safety alert via the App
- Share the user\'s last known GPS location with nominated emergency contacts
- Where technically feasible and network-dependent, assist in alerting emergency services
2.2 The Emergency Feature is not a direct telephone connection to 999 or 911.
2.3 The Emergency Feature\'s effectiveness is entirely dependent on --- and GodsOwnApp Limited accepts no liability for failure arising from:
- Mobile network connectivity (4G/5G or Wi-Fi)
- GPS signal availability and accuracy
- Device battery life and App being active on the device
- Nominated contacts being reachable and responsive
- Emergency services receiving, acting on, or responding to any alert
- Any third-party network, infrastructure, or service
2.4 GodsOwnApp Limited cannot and does not guarantee that:
- Any emergency alert will reach nominated contacts or emergency services
- Location data will be accurate at the time of any alert
- Emergency services will be contacted, dispatched, or respond
- The feature will function in any specific location, building, or at any specific time
3. Signal Responsibility --- Emergency Contexts
3.1 In buildings or venues where 4G or 5G signals are weak or absent, it is the sole and absolute responsibility of the User, the venue operator, or the Organisation to install and maintain mobile signal amplifiers or Wi-Fi calling infrastructure.
3.2 GodsOwnApp Limited accepts no liability --- including for injury or death --- arising from any failure of the Emergency Feature due to inadequate signal or connectivity at any location.
4. Absolute Exclusion of Liability --- Emergency Feature
4.1 To the maximum extent permitted by law, GodsOwnApp Limited expressly and absolutely excludes all liability to any person for:
- Any failure of the Emergency Feature to activate, connect, transmit, or alert;
- Any delay, inaccuracy, or failure in GPS location data;
- Any failure of nominated contacts to receive, read, or respond to an alert;
- Any failure of emergency services to be notified, dispatched, or respond;
- Any injury, loss, or death arising from reliance on the Emergency Feature as a primary or sole means of emergency contact;
- Any failure arising from inadequate signal, device failure, battery depletion, App crash, or network outage;
- Any outcome --- including injury or death --- of any emergency event in connection with which the Emergency Feature was or was not used.
4.2 The maximum aggregate liability of GodsOwnApp Limited arising from or in connection with the Emergency Feature shall not exceed £1.00 (UK) / $1.00 (USA) in any circumstances.
4.3 No director, officer, employee, or agent of GodsOwnApp Limited shall be personally liable - jointly or individually - for any failure of the Emergency Feature or any outcome arising from its use or non-use.
4.4 Statutory exception: Nothing above excludes GodsOwnApp Limited\'s liability for death or personal injury caused by its own proven gross negligence or fraud, as required under the Unfair Contract Terms Act 1977 (UK). This exception is narrow and does not extend to any failure of technology, third-party networks, or emergency service response.
5. User Acknowledgement --- Mandatory
5.1 By activating and using the Emergency Feature, each User irrevocably confirms that they:
- Understand the Emergency Feature is a supplementary aid only;
- Will always call 999 (UK) or 911 (USA) directly as their primary emergency contact method;
- Accept full and sole responsibility for any outcome arising from their use of or reliance on the Emergency Feature;
- Have ensured adequate mobile signal or connectivity at locations where they intend to rely on this feature;
- Have obtained consent from nominated emergency contacts before designating them;
- Will test the feature regularly and maintain alternative emergency contact methods.
6. Prohibited Use - False Alerts
6.1 Use of the Emergency Feature to raise a false, malicious, or deliberately misleading emergency alert is strictly prohibited and is a criminal offence.
6.2 In the UK, a false emergency alert may constitute an offence under the Criminal Law Act 1967, the Communications Act 2003, and/or the Malicious Communications Act 1988.
6.3 In the USA, a false emergency alert may constitute an offence under 18 U.S.C. § 1038 and applicable state law.
