All our products are sold strictly on the basis that you as a subscriber/user must to make sure that the App is installed correctly and periodically tested to ensure all three rescuers are active 24/7 so in an emergency you have 100% reliability. Our liability is limited to the sale value of the App, proportionally adjusted to the day of any particular incident that you as a user is seriously dissatisfied with, but with the promise that we will do everything in our power to rectify any technical issues as soon as it is reported and within a reasonable time-frame.
Neither Party (You or US) shall be considered in breach of this product and service usage Agreement or liable for any delay or failure to perform its obligations under this Agreement, if and to the extent that such delay or failure is caused by or results from acts, events, or circumstances beyond its reasonable control, including but not limited to: 1. Acts of God, natural disasters, or extreme weather conditions, including but not limited to earthquakes, floods, hurricanes, tornadoes, severe storms, or other natural disasters; 2. Effects of climate change and resulting adverse weather patterns or environmental conditions; 3. War (whether declared or not), invasion, acts of foreign enemies, civil war, rebellion, revolution, terrorism, or military or usurped power; 4. Civil unrest, riots, civil commotion, strikes, lockouts, or labour disputes;5. Epidemics, pandemics, or quarantine restrictions;6. Acts of government or regulatory authorities, including changes in law or regulations; 7. National or regional emergency; 8. Breakdown of essential utilities, including electricity, gas, water, or telecommunications; 9. Any other similar events beyond the reasonable control of the affected Party.
If the Force Majeure Event prevents, hinders, or delays performance of either Party's obligations for a continuous period of more than 90 days, either Party may terminate this Agreement by giving 30 days' written notice to the other Party.
